Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Accelerate School of Motoring - ABN 71 613 719 707.

Terms & Conditions

Deposits and block booking payments are non-refundable should the customer choose not to take up driving lessons with Accelerate School of Motoring.

Packages must be used within 6 months of purchase.

Students must ensure there is availability for the bookings of their choice. Refunds will not be given in the event there are no spaces for their preferred booking/test.

Cancellations- A minimum of 24 hours' notice must be given directly to the instructor via their mobile phone or a cancellation charge will be made.

Road Safety – We reserve the right to withdraw our cars from tests without notice should a pupil not be up to test standard.

Responsibility – We cannot be held responsible for postponements of lessons or tests due to illness or mechanical breakdown.

If the instructor deems you are not fit to drive, they have the right to cancel the lesson and you will be charged the full lesson rate.

Using your own Vehicle - If you choose to use your own vehicle you will need to complete an indemnity form prior, we are not responsible for any incident or breakdown.  The instructor will check your Rego & Insurance prior to the lesson beginning.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that Accelerate School of Motoring can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. Accelerate School of Motoring cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• Accelerate School of Motoring has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Accelerate School of Motoring service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Accelerate School of Motoring has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Accelerate School of Motoring service. Such termination of the Service will result in the deactivation of your Account.
  

Cancellation Rates

• Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Accelerate School of Motoring.

 

Refund Policy

Cancellation

Your custom and satisfaction are important to us and we hope you do not have to cancel any lessons, however, we are sure you understand that running a small business is costly, therefore we operate a 24 hour cancellation policy. 

If you are not able to make your confirmed lesson and give less than 24 hours notice we will have to charge you the full cost of that lesson.

There is high demand for lessons and this covers the cost of the instructor blocking that time out for your lesson and being unable to instruct anyone else at short notice.

In the unfortunate event the instructor has to cancel you will be informed at the earliest possible time and a full refund will be given. Along with priority booking for the next lesson.

Modifications to Services and Prices

• Accelerate School of Motoring reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• Accelerate School of Motoring shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Packages

• Packages are non-refundable and cannot be redeemed for cash.
• Unused packages cannot be transferred between clients.
• Purchases containing multiple packages can only be used by a single person and cannot be split between people.
• Packages are valid for 12 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Accelerate School of Motoring for payment processing.
  
• All fees and transactions are in Australian Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Accelerate School of Motoring.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Accelerate School of Motoring customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that Accelerate School of Motoring uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• Accelerate School of Motoring does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that Accelerate School of Motoring shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Accelerate School of Motoring has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of Accelerate School of Motoring to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that Accelerate School of Motoring shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
